You have stated that the same garment is being imported as Style 4766C in youth sizes 8-20. Both garments will also be imported in different colors as Styles 776CL and 476CL. Style 7763C is a pair of men's pants constructed from 100 percent nylon, woven satin fabric. The pants feature a fabric covered tunnel elastic waistband with an inside drawstring; side seam pockets; zippered openings at the ankles; and tunnel elastic cuffs. There is an embroidered logo on the upper portion of the left leg.

Dear Ms. Brown-Davis: In your letter, dated October 28, 1997, you requested a tariff classification ruling. As requested, your samples will be returned. Style 7766C is a man's pullover garment constructed from 100 percent polyester, finely knit fabric which is brushed on the inside surface. The fabric measures more than 9 stitches per two centimeters counted in the horizontal direction. The pullover features a rib knit V-neckline; long sleeves with rib knit cuffs; and a rib knit waistband. There is a large team logo embroidered across the front chest. Style 7763C is a pair of men's pants constructed from 100 percent nylon, woven satin fabric. The duty rate will be 33.5 percent ad valorem. The applicable subheading for Style 7763C will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' ... trousers, bib and brace overalls, breeches and shorts (other than swimwear): of synthetic fibers: other: other: other: other: other: trousers and breeches: men's. The duty rate will be 29.2 percent ad valorem. Styles 7766C, 4766C, 776CL and 476CL fall within textile category designation 638. Style 7763C falls within textile category designation 647. Based upon international textile trade agree- ments, products of Korea are subject to visa requirements and quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
