Dallas Road Suite 100 Grapevine, TX 76051 RE: The tariff classification of a headband from China Dear Mr. Mosley: In your letter dated August 26, 1997, you requested a tariff classification ruling on behalf of Mary Kay, Inc. The submitted sample, no style given, is a 100% cotton woven terry cloth headband. The back portion is elasticized and the front features a stitched down bow which has been tied in a knot. The bow is outlined in pink piping. A small label with the "Mary Kay" logo on one side and the RN number on the reverse is sewn under one edge of the bow. The applicable subheading for the headband will be 6217.10.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: accessories: other: headbands, ponytail holders and similar articles. The rate of duty will be 15.2 percent ad valorem. There is no textile category designation at this time. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
