Cammarosano 15 Park Row New York, NY 10038 RE: The tariff classification of a food supplement and acupuncture needles from China Dear Mr. Cammarosano: In your letters dated July 8, 1997 and July 18, 1997 you requested a tariff classification ruling. Samples, submitted with your second letter, were examined and disposed of. The acupuncture needles are packaged in boxes containing 100 sterilized needles, each in a protective sheath, mounted on a paper-backed, clear plastic blister. They will be sold to licensed acupuncture practitioners. The applicable subheading for the acupuncture needles will be 9018.39.0050, HTS, which provides for instruments and appliances used in medical, surgical, dental or veterinary sciences...syringes, needles, catheters, cannulae and the like...other...other. The rate of duty will be 1.7 percent ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on the Panax Ginseng Extract food supplement. Your request for a classification ruling must include a complete ingredients breakdown, by weight. Please note that we had previously requested this same information in a letter to you dated July 15, 1997 (file no. B87492). This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
