Dear Ms. Mogaddam: In your letter dated June 18, 1997, you requested a tariff classification ruling. Three samples were submitted with your letter, one each of a disposable vomit bag and a men's and a women's disposable toilet bag. The vomit and toilet bags are composed of polyethylene. Each bag contains a quantity of acrylate polymer crystals, which will absorb from 500 to 600 cc of fluid and instantly thickens the fluid to form a gel. The bags are meant for use by the young, elderly, those with limited mobility, automobile and airline travelers, campers and hikers. The applicable subheading for the vomit and toilet bags will be 3923.21.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for the conveyance or packing of goods, of plastics...sacks or bags, of polymers of ethylene, other. The rate of duty will be 3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
