Sullivan MSAS Customs Logistics Inc. 246-06 Rockaway Boulevard Jamaica, NY 11422 RE: The tariff classification of a woman's dress from Hong Kong Dear Mr. Sullivan: In your letter dated March 17, 1997, you requested a classification ruling on behalf of Newport News, Inc. The sample submitted with your request will be returned to you under separate cover. Style 00260 is a dress constructed from 70 percent rayon\30 percent polyester woven fabric. The fully lined dress features long sleeves, a collar, lapels, shoulder pads and a full front opening secured by six buttons. The dress also has two chest pockets and two pockets below the waist. The applicable subheading for style 00260 will be 6204.44.4010, Harmonized Tariff Schedule of the United States (HAS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of artificial fibers: other: other: women's. The duty rate will be 16.7 percent ad valorem. Style 00260 falls within textile category designation 636. Based upon international textile trade agreements products of Hong Kong are subject to a visa requirement and quota restraints.
