Dear Mr. Johnston: In your letter dated January 21, 1997, on behalf of Olivetti Personal Computers USA, Inc., you requested a tariff classification ruling. As indicated in your ruling, the items in question consist of a lithium ion battery, an AC adapter/power supply, an electrical cable with connector, a RAM memory module, and an internal modem for the laptop. The applicable subheading for the lithium ion battery will be 8507.80.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric storage batteries. The general rate of duty will be 4.1 percent ad valorem. The applicable subheading for the AC adaptor/power supply will be 8504.40.70, HTS, which provides for other power supplies for automatic data processing machines or units thereof. The general rate of duty will be 1.2 percent ad valorem. The applicable subheading for the electrical cable with connector will be 8544.41.0000, HTS, which provides for other electric conductors, for a voltage not exceeding 80 V, fitted with connectors. The general rate of duty will be 3.7 percent ad valorem. This classification is based on the presumption that the rated voltage does not exceed 80 V. The applicable subheading for the RAM memory module will be 8473.30.1000, HTS, which provides for parts and accessories of the machines of heading 8471, printed circuit assemblies. The general rate of duty will be free. The applicable subheading for the internal modem will be 8517.50.1000, HTS, which provides for modems, of a kind used with data processing machines of heading 8471. The general rate of duty will be 3.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
