Varga ComGenex USA, Inc. 5 Independence Way, Suite 300 Princeton, NJ 08540 RE: The tariff classification of a MultiReactor from Hungary Dear Dr. Varga: In your letter dated July 24, 1996, you requested a tariff classification ruling. The MultiReactor consists of a reaction unit and a control unit, interconnected by a flexible cable. The MultiReactor is designed for use in matrix-type chemical reaction where the reaction conditions can be uniformly set. The reaction unit (also referred to as the heater-mixer unit) consists of 24 openings needed for the accommodation of the reaction vessels, thus enabling the unit to carry out up to 24 similar reactions simultaneously. This unit contains heating and cooling coils which surround the reaction vessel holders. It also features a platinum sensor unit for measuring the temperature of the reaction vessels. Data obtained through use of this sensor is then fed back to the control unit. The mixing system consists of a motor situated underneath each reaction vessel holder. Each reaction vessel holder has a permanent magnet attached to the axis of the motor. A teflonized magnetic bar is placed in each reaction vessel. Once the reaction vessel is placed in the heater-mixer unit, the liquid is stirred. The rate of the rotation of the permanent magnet can be controlled and set. The control unit allows the setting of the temperature of the reactions and the mixing (rotation) conditions. The mixing, while essential, is a secondary function designed to facilitate the principal function of the MultiReactor, i.e., the heating/cooling. The applicable subheading for the MultiReactor will be 8419.89.9085, Harmonized Tariff Schedule of the United States (HTS), which provides for machinery, plant or laboratory equipment, whether or not electrically heated, for the treatment of materials by a process involving a change of temperature such as heating, cooking, roasting, distilling, rectifying, sterilizing, pasteurizing, steaming, drying, evaporating, vaporizing, condensing or cooling, other than machinery or plant of a kind used for domestic purposes; ... : other. The rate of duty will be 4.2 percent ad valorem. Articles classifiable under subheading 8419.89.9085, HTS, which are products of Hungary are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations, if the GSP is renewed. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
