Sprowl Nippon Express U.S.A., Inc. 410 Airpark Center Drive Nashville, TN 37217 RE: The tariff classification of automotive rear suspension pins from Japan Dear Mr. Sprowl: In your letter dated May 23, 1996 you requested a tariff classification ruling on behalf of Nissan Trading Corp. U.S.A. of Farmington Hills, Michigan. The items in question are two specifically-shaped pieces of metal in sets of two. One set is of "axle-side" pins (Part #56226-01G01); these have a body of 3"L X 2«" in circumference with a 5/8" thread at one end which has a circumference of 2". The other set is of "frame-side" pins (Part #50424-31G00); these have a body of 4 "L X 2«" in circumference with a 4" circumference, integrated, metal ring surrounding the body 3¬" from one end and a "L X 2" in circumference thread at the opposite end. You state in your letter that the shipper/seller of these items is Nissan Trading Co., Ltd. of Tokyo, Japan. In the diagrams which accompany your letter, you further state that the "axle side" pins are welded to the rear suspension spring seat of a Nissan Pickup truck and their function is to impart the damping force of a shock absorber to the rear transmission and that the "frame-side" pins are welded to the rear suspension frame of a Nissan Pickup truck and their function is to impart the damping force of a shock absorber to the truck body. The applicable subheading for both types of rear suspension pins will be 8708.99.7060, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of . . . motor vehicles . . . : Other parts and accessories: Other: Other: Other: Parts for suspension systems: Other. The rate of duty will be 2.9% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
