Dear Ms. Ruckner: In your letter dated February 6, 1996, you requested a tariff classification ruling. You sent two samples. One is item H8981 that consists of a lidded acrylic tumbler containing fantasy-shaped, colored plastic ice-cubes. The other is item H4420 which consists of fanciful-topped acrylic stirrers packed in a plastic throw-away container. The applicable subheading for both items will be 3924.10.5000 Tariff Schedule of the United States, which provides for tableware, kitchenware, other household articles of plastics: Tableware and kitchenware: Other. The rate of duty will be 3.4 per cent. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. Sincerely, Jayson P.
