Dear Mr. Vandersluis: In your letter dated October 18, 1990, on behalf of Oroton Inc., you requested a tariff classification ruling. The submitted sample is a backpack/tote designed with a handle to be carried by hand in addition to being worn on the back. The item measures approximately 13" x 11 1/2" x 8". It is lined with a textile material with an outer surface constructed of (PVC) plastic sheeting. The bag has a full width inside zippered pocket and is closed by means of a drawstring closure with a plastic interlock fastener. Your sample is being returned per your request. The applicable subheading for the backpack/tote of plastic sheeting will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of plastic sheeting, other. The duty rate will be 20 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
