Dear Mr. Langenskiold: In your letter dated October 2, 1995, you requested a tariff classification ruling. The cover will be imported in the form of lay-flat tubing. This cover is disposable and will be used to package the "Easyslide", which is used in patient care. The type of plastic was not stated in your letter, and so we are unable to provide a statistical suffix to accompany the subheading provided below. The applicable subheading for the plastic cover will be 3917.32.60, Harmonized Tariff Schedule of the United States (HTS), which provides for tubes, pipes and hoses, and fittings therefor, of plastics, other, not reinforced or otherwise combined with other materials, without fittings, other. The duty rate will be 3 percent ad valorem. Articles classifiable under subheading 3917.32.60, HTS, which are products of Poland are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations, if the GSP is renewed. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
