Dear Ms. Curbelo: In your letter dated November 24, 1997, you requested a tariff classification ruling. You have submitted photo copies of five samples of plastic kitchenware. Item #H-38-I-0671 is a plastic wine glass measuring 3.5 inches in diameter and 7 inches high. Item #H-38-I-0675 is a plastic service tray measuring 16.5 inches by 12 inches. The rate of duty will be 6.7 percent ad valorem. The rate of duty will be 6.6 percent ad valorem for 1998. The applicable subheading for the both of the plastic trays mentioned above will be 3924.10.3000, HTS, which provides for tableware, kitchenware, other household articles...of plastics; tableware and kitchenware: trays. The rate of duty will be 5.3 percent ad valorem. The rate of duty will remain the same for 1998. The rate of duty will be 3.4 percent ad valorem. The rate of duty will remain the same for 1998. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
