Dear Ms. Bonace: In your letter dated July 27, 1995, you requested a tariff classification ruling. You have submitted a sample of an angel tree topper ornament, Blair product #753301. The item is a lighted 12" tall figure of an angel. It has porcelain head and hands, a textile dress and textile wings. The angel holds an artificial pine garland in her hand. The angel is lighted, and the lights are equipped with a plug, which is designed to be plugged into the lighting sets used on a Christmas tree. The applicable subheading for the angel tree topper will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof, Christmas ornaments, other, other. This item number is free of duty. Your sample is returned as you requested. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
