The item concerned is the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U]. It is a geared, clutch assembly powered by a brushless, DC motor outputting less than 18.65 Watts. The purpose of the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] is to automatically slide open the right side panel door of a vehicle. The applicable classification subheading for the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] will be 8501.10.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric motors … : Motors of an output not exceeding 37.5 W: Of under 18.65 W: Other: DC: Brushless”. Each of the non-originating materials used to make the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] has satisfied the changes in tariff classification required under HTSUS General Note 12(t), Chapter 85., Chapter rule 7, 1. (A). The Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] will be entitled to a Free rate of duty under the NAFTA upon compliance with all applicable laws, regulations, and agreements.
