Dear Ms. Bennett: In your letter dated May 9, 2006 you requested a tariff classification ruling. The item in question is a galls hurricane style candleholder with a metal base. It is 10” in width and 16 ¾ “ in overall height. It is composed of a glass candleholder in the hurricane style with a metal base. The hurricane glass portion sits on the metal base and the base serves as the support for a columnar candle. The item is designed for candlelight illumination. The applicable subheading for the glass hurricane style candleholder will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Non-electrical lamps and lighting fittings: Other: Other. The rate of duty will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.
