In addition to product literature, you included a letter of May 9, 2005 from Mr. Roy Smith of Allertex in which he states that the Laroche Supertrim 500 Opener is a machine used in the preparation of textile fibers. It takes rags and shreds them back into a manageable fiber that can be presented in a form that is easier to process. The literature states that the machine is designed to open edge trims from nonwoven lines back into fibers. The machine includes a feeding system with feed roll working with an adjustable pressure on a dish and one opening cylinder with pins or wire. The applicable subheading for the Laroche Supertrim 500 Opener will be 8445.19.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for machines for preparing textile fibers: other. The rate of duty will be 3.3 percent. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
