You submitted descriptive literature with your request. The subject merchandise is product CHM-Q3720-590, described as chocolate discs. These are one-kilogram tablets that will be imported ten to a bag. The importer in the US will melt them and use them to enrobe cakes, pastries, and confectionery. The discs are said to consist of 37.5 percent sugar, 25 percent cocoa butter, 25 percent dry whole milk, 12 percent cocoa paste, and traces of lecithin. The total milk fat is stated as 6.7 percent and the total milk solids are 25 percent. The general rate of duty will be 3.5 percent ad valorem. If the quantitative limits of additional U.S. note 8 to chapter 17 have been reached, the product will be classified in subheading 1806.90.2000, HTS, and dutiable at the rate of 52.8 cents per kilo plus 6 percent ad valorem. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
