Greenwood, SC 29649 RE: The tariff classification of Oil Blue 613 from Japan Dear Mr. Kinney: In your letter dated January 19, 2005, you requested a tariff classification ruling. The subject product, Oil Blue 613, is a coloring preparation containing the synthetic, organic, solvent dye, Solvent Blue 5 (CAS Registry Number: 1325-86-6). You indicate in your letter that the product is intended for use as an ingredient in a coating solution used in the manufacture of presensitized printing plates. The applicable subheading for Oil Blue 613 will be 3204.19.2595, Harmonized Tariff of the United States (HTS), which provides for “Synthetic organic coloring matter and preparations based thereon as specified in note 3 to this chapter: Other, including mixtures of coloring matter of two or more of the subheadings 3204.11 to 3204.19: Solvent dyes and preparations based thereon: Other: Other: Other.” The rate of duty will be 6.5 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which is administered by the U.S. Environmental Protection Agency (EPA).
