Dear Ms. Lee: In your letter dated June 8, 2004, on behalf of your client Apex Digital Inc., you requested a tariff classification ruling. The item in question is denoted as the Apextreme DVD player/PC game unit. This device connects directly to a television and other video devices. It is designed to play video DVDs for viewing on a television as well as audio CDs. It is compatible with video DVDs, CD-Audio discs, CD-R/RW discs, and MP3 files recorded onto a suitable disc. It also has USB connections allow for use with an ADP system thus allowing the user to play DVD video games. The applicable subheading for the Apextreme DVD player/PC game unit will be 8521.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Video recording or reproducing apparatus, whether or not incorporating a video tuner: Other.
