Dear Ms. Cummings: In your letter dated February 27, 2004, you requested a ruling on tariff classification. The merchandise is closet rods (oval tubes) and bracket hangers. The oval tubing designated 880 measures 30 mm high by 15 mm wide in diameter, has a wall thickness of 1.2 mm and will be imported in lengths of either 96 inches or 144 inches. The oval tubing designated 882 measures 30 mm high by 15 mm wide in diameter, has a wall thickness of 0.8 mm and will be imported in lengths of either 96 inches or 144 inches. These tubes are produced from cold-rolled flat-rolled steel which is roll formed to shape, electrically welded and chrome plated. The applicable subheading for these oval tubes will be 7306.60.5000, HTS, which provides for other tubes, pipes and hollow profiles (for example, open seamed or welded, riveted or similarly closed), of iron or steel, other, welded, of noncircular cross section, having a wall thickness of less than 4 mm, of iron or nonalloy steel. The rate of duty will be free. The bracket hangers are made of zinc or of plastic. The applicable subheading for the zinc product will be 8302.50.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal hat-racks, hat pegs, brackets and similar fixtures, and parts thereof. The general rate of duty will be free. The applicable subheading for the plastic product will be 3925.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for builders’ ware of plastics, not elsewhere specified or included: other. The general rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
