Your sample will be returned. Style SMA6645T is a women’s sleeveless poncho constructed from 94% polyester, 3% wool, 1% spandex, and 2% other knit fabric. The pullover style garment covers the elbows and reaches the waist. The poncho features a round neckline and a bottom finished with knotted fringe. You requested classification of style SMA6645T under 6117.10.2030, Harmonized Tariff Schedule of the United States (HTSUS). However, the garment is more specifically provided for under heading 6102, H TSUS. Consequently, the applicable subheading for style SMA6645T will be 6102.30.2010, HTSUS, which provides for Women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: Of man-made fibers: Other: Other: Women’s. The general rate of duty will be 28.2 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
