Dear Ms. Gomez: In your letter dated June 15, 2023, you requested a tariff classification ruling. Images were submitted in lieu of a sample. The product under consideration, item number FTTB, is a toothbrush that is designed to be worn on the user’s fingertip and does not feature a handle. It is molded in one piece from polypropylene plastic. The toothbrush features bristles on one side and a tongue scraper on the opposite side. It measures 1 inch (height) by .95 inches (width) by .75 inches (length). The applicable classification for this fingertip toothbrush, item number FTTB, will be 9603.21.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “[b]rooms, brushes (including brushes constituting parts of machines, appliances or vehicles), hand-operated mechanical floor sweepers, not motorized, mops and feather dusters; prepared knots and tufts for broom or brush making; paint pads and rollers; squeegees (other than roller squeegees): [t]oothbrushes, shaving brushes, hair brushes, nail brushes, eyelash brushes and other toilet brushes for use on the person, including such brushes constituting parts of appliances: [t]oothbrushes, including dental-plate brushes.” The general rate of duty is Free. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 9603.21.0000, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 9603.21.0000, HTSUS, listed above. The HTSUS is subject to periodic amendment, so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
