Garments of this chapter designed for left over right closure at the front shall be regarded as men's or boys' garments, and those designed for right over left closure at the front as women's or girls' garments. These provisions do not apply where the cut of the garment clearly indicates that it is designed for one or other of the sexes. Garments which cannot be identified as either men's or boys' garments or as women's or girls' garments are to be classified in the headings covering women's or girls' garments. Since the garment does not have any closures, is not specifically designed for one gender over the other, and will be featured in sizes XS to XXL, accommodating both sexes, the garments will be classified under the women’s subheadings.

LLC DBA Giant Fish 2864 SW Champlain Drive Portland, OR 97205 RE: The tariff classification of paddling top from China Dear Mr. Darling: In your letter dated February 28, 2023, you requested a tariff classification ruling.  The sample will be returned to you, as requested. Style DW2205 is a unisex paddling top.  The top is constructed from 90% polyester 10% spandex knit coated with a silicone material that completely obscures the underlying fabric.  The pullover garment features flatlock seams, a mock turtleneck, raglan sleeves, and a hem with an elastic drawcord for tightening. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheadings 6113.00.1010, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty.  At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheadings 6113.00.1010, HTSUS, listed above.
