Dear Mr. Hager: In your letter dated May 4, 2021, you requested a tariff classification ruling. Images were submitted in lieu of a sample. The product under consideration is described as “geocells” and will be made wholly from high-density polyethylene (HDPE). The expanded cellular grid will be laid on a sloping driveway and filled with gravel. Please refer to New York Ruling N014071, dated July 24, 2007, in which we previously ruled upon geocells. As the geocells grid would be considered an article of plastic, and as it is not more specifically provided for elsewhere, the applicable subheading will be 3926.90.9985, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “[o]ther articles of plastics and articles of other materials of headings 3901 to 3914: [o]ther: [o]ther: [o]ther.” The column one, general rate of duty is 5.3 percent ad valorem. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 3926.90.9985, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 3926.90.9985, HTSUS, listed above. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
