One CVS Dr. Woonsocket, RI 02895 RE: The tariff classification of a stylus-ball point pen from China. Dear Mr. Kenny: On January 22, 2021, you submitted a ruling request on behalf of your client, CVS Pharmacy Inc. Images and descriptive information were provided. The “No Touch Pen,” CVS item number 278408, is a ball point pen combined with a stylus for use with a touch screen on a device. The ball point pen is roller ball type pen using gel ink. The stylus is made from electrically conductive silicone. When the stylus touches the mobile phone or tablet, it will produce friction, making static electricity, to mark the screen electronically. There are no active electrical parts in the unit. The applicable subheading for the “No Touch Pen” will be 9608.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ball point pens. The rate of duty will be 0.8 cents each plus 5.4 percent ad valorem. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheadings, 9608.10.0000, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheadings 9608.10.0000, HTSUS. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
