Dear Mr. Braeunig: In your letter dated January 5, 2021, you requested a tariff classification ruling. Images were submitted in lieu of a sample. The product under consideration is described as a foam water pad. It is constructed from XPE, which is a cross-linked polyethylene plastic foam. Per your submission, the pad features a grommet and tether that can be used for attaching an anchor, which would not be included with the pad. You also indicate the water pad size and thickness could vary. An example size is five feet wide by 12 feet long and 1.25 inches thick. The pad is designed to be used by consumers to float on the water in a pool or lake environment. There are two nylon straps included to roll it up for storage. As the foam water pad would be considered an article of plastic, and as it is not more specifically provided for elsewhere, the applicable subheading will be 3926.90.9985, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “[o]ther articles of plastics and articles of other materials of headings 3901 to 3914: [o]ther: [o]ther: [o]ther.” The column one, general rate of duty is 5.3 percent ad valorem. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 3926.90.9985, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 3926.90.9985, HTSUS, listed above.  The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
