Ingredients breakdowns, a narrative description of the manufacturing process, a manufacturing flowchart, and photocopies of the products were submitted with your letter. ThauMagic Thaumatin 10% is a sweetener said to contain thaumatin and maltodextrin. ThauMagic Thaumatin 45% is a sweetener said to contain thaumatin, carbohydrates, ash and sodium. ThauMagic Thaumatin 93% is a sweetener said to contain thaumatin, sodium salts and carbohydrates. The thaumatin products are derived from the katemfe fruit, thaumatococcus daniellii, harvested in West Africa. These thaumatin products will be principally used in combination with other ingredients as a sweetener in lieu of sugar to produce food and beverage retail products. The general rate of duty will be 6.4 percent ad valorem. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 2106.90.9898, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 2106.90.9898, HTSUS, listed above. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
