The sugar and cocoa mixture will be imported in polyethylene bags with a gross weight of 1.21 pounds per cardboard box and used as a filling for wafer cookies manufactured by Bauducco in the United States. In your letter, you suggest classification under 1901.20.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Malt extract; food preparations of flour, groats, meal, starch or malt extract, not containing cocoa…: Mixes and doughs for the preparation of bakers’ wares of heading 1905: Other: Other: Other: Other. We note that there is no flour or other ingredients such as eggs, butter or milk that would often be present in mixes or doughs used to create products considered as bakers’ ware of heading 19.05 (e.g., pancakes, biscuits, cakes, bread). The subject merchandise is described as a sugar and cocoa blend. The sugar and cocoa mixture contains 93.36 percent sugar and 6.64 percent cocoa by weight. The sugar is refined from sugar cane with a minimum polarity of 99 degrees in Brazil. The cocoa, which is a product of Brazil, is composed of 100 percent cocoa powder.
