Ltd 18300 Von Karman Avenue Irvine, CA 92612 RE: The tariff classification of effervescent dietary supplements from China Dear Ms. Wang: In your letter dated January 6, 2020, you requested a tariff classification ruling. Samples, ingredients breakdowns, manufacturing narrative descriptions and flowcharts accompanied your inquiry. The samples were examined and discarded. Hydration Effervescent tablets are said to contain citric acid, sodium bicarbonate, cane sugar, potassium bicarbonate, L-leucine, orange strawberry flavor, magnesium carbonate, stevia, calcium carbonate, beet powder, maltodextrin and vitamin B2. Effer-Energy Effervescent tablets are said to contain citric acid, sodium bicarbonate, cane sugar, potassium bicarbonate, L-leucine, mango pineapple grapefruit flavor, green tea extract, magnesium carbonate, stevia, calcium carbonate, beta carotene, vitamin B3, maltodextrin, vitamin B12 and vitamin B6. The two products will be imported encapsulated and packaged in bulk. The applicable subheading for the two products will be 2106.90.9898, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or included . . . other . . . other . . . other . . . other . . . other . . . other. The general rate of duty will be 6.4 percent ad valorem. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 2106.90.9898, HTSUS, unless specifically excluded, are subject to an additional 15 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 2106.90.9898, HTSUS, listed above. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
