Dear Mr. Slyper: In your letter dated June 6, 2018, you requested a tariff classification ruling. The submitted sample is being retained by our office. Item # 340195, Mom-To-Be Sash, is made of woven polyester fabric. The sash is approximately four inches wide and 72 inches in length with flowers attached to the sash and printed “Mom-To-Be” on the front of the sash. You have suggested classification as a non-durable costume under subheading 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other. We disagree with your proposed classification. The sash is not a garment and the wearer does not create an image of anything other than herself. The applicable subheading for Item number 340195 will be 6217.10.9530, HTSUS, which provides for Other made up clothing accessories…Accessories: Other: Other, Of man-made fibers: Other. The duty rate will be 14.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
