Dear Ms. Benedetto: In your letter dated November 9, 2016, you requested a tariff classification ruling. The submitted sample, identified as the Adult Size Sparkle Tutu, style number OEM17-0397, is an adult size flimsy three layer tutu constructed of man-made textile fabric. The tutu features raw edges with hanging threads on all three layers and a loose single straight stitch joining the exposed elastic waist band. The applicable subheading for style number OEM17-0397 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; Parts and accessories thereof: Other: Other.” The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
