Box 269 609 Tucker Street Burlington, NC 27216-0269 RE: The tariff classification of filament yarn from India Dear Mr. Murray: In your letter dated October 7, 2016, you requested a tariff classification ruling. You submitted a photo of a yarn described as a synthetic filament, textured yarn composed of 100 percent polyester. The yarn construction is 3 ply, having a denier of 300, 68 filament (3/300/68). You state that the yarn is used in commercial braiding application to make draw-string cordage. Each package of yarn will weigh 10 pounds and will be put onto a 10 inch paper tube. According to the terms of Note 4 to Section XI, Harmonized Tariff Schedule of the United States (HTSUS), the yarn does not meet the definition of “put up for retail sale.” The applicable subheading for the textured polyester yarn will be 5404.19.8040, HTSUS, which provides for synthetic monofilament of 67 decitex or more and of which no cross-sectional dimension exceeds 1 mm ... monofilament, ... of polyesters. The rate of duty will be 6.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
