Witt NanoMech Inc. 2447 Technology Way Springdale, AR 72764 RE: The tariff classification of “GUARDx Premium Corrosion Inhibitor” from the United States Dear Ms. Witt: This is in response to your submission received August 8, 2016, requesting a ruling on the classification of “GUARDx Premium Corrosion Inhibitor,” which is being exported from the United States to undisclosed countries. Pursuant to 19 C.F.R. Part 177, U.S. Customs and Border Protection (CBP) issues rulings concerning, among other things, the tariff classification of imported articles. Because this transaction involves an export from the United States, this office will issue an “information letter” pursuant to the authority of 19 C.F.R. § 177.1(d)(2). It is expressly noted that information letters are intended to assist importers in their Customs transactions, but do not have the binding effect of a ruling letter. In your letter, you describe the product at issue as a liquid corrosion inhibitor, intended to be used as a coating on machinery, carbo steels, stainless steel, aluminum, cast iron, copper and alloy. You state that the main components in the formulation are silicone grease, halox, n-heptane, novinox, vanlube, and other substances. The applicable subheading for “GUARDx Premium Corrosion Inhibitor” will be 3403.99.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Lubricating preparations (including cutting-oil preparations, bolt or nut release preparations, antirust or anticorrosion preparations and mold release preparations, based on lubricants) and preparations of a kind used for the oil or grease treatment of textile materials, leather, furskins or other materials, but excluding preparations containing, as basic constituents, 70 percent or more by weight of petroleum oils or oils obtained from bituminous minerals: Other: Other. The general rate of duty will be 6.5 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
