Dear Ms. Kessens: In your letter dated September 2, 2015, you requested a tariff classification ruling. The sample submitted will be returned to you. Item number 16442201 is described as a “Patriotic Flag Wind Blazer”. The item is made of flocked polyethylene (PE) and a cardboard tube. The PE is cut into strips, and then wrapped over the tube used for hanging, with the strips sewn just under the tube to secure them. The strips are approximately 1 cm in width. The item resembles the U.S. flag and can be used indoors or outdoors. The applicable subheading for the Patriotic Flag Wind Blazer will be 4602.90.0000, Harmonized Tariff articles, made directly to shape from plaiting materials or made up from articles of heading 4601: other (than of vegetable materials). The rate of duty will be 3.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
