Global Enterprises, Incorporated 1309 South Fountain Drive Olathe, KS 66061 RE: The tariff classification of a lift system drape and sling from China Dear Ms. Schroeder: In your letter dated April 22, 2015 you requested a tariff classification ruling. Two samples were submitted with your letter. The first sample is identified as a UNACure Drape, sample #2015-061 and item #2000-8000.  This item is made of translucent polyethylene (PE) plastic sheeting material.  It is a disposable cover with a pouch-like opening that is designed to enclose a universal mobile floor-based lift in a hospital for the purpose of keeping the lift sterile during surgical procedures. The applicable subheading for the UNACure Drape will be 3926.90.9995, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other articles of plastics and articles of other materials of headings 3901 to 3914: Other: Other: Other.” The duty rate will be 5.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on the World Wide Web at http://www.usitc.gov/tata/hts/. The second sample is identified as a UNACure Sling, sample #2015-062 and item #2000-1000. The nonwoven polypropylene sling is intended to be used with universal mobile floor-based lifts in hospitals for safe patient handling and care prior to and during surgical procedures. The polyester straps at each end of the sling attach to the lift creating a cradle for the patient’s limb allowing the lift to support some of the weight of the patient. The question of classification for the UNACure Sling is being referred to U.S. Customs and Border Protection, Regulations & Rulings, 799 9th Street N.W. - 7th floor, Washington, DC 20229-1177. A ruling will be issued to you from that office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
