The sample is described as a magnetic wrist wrap, Item #07205302. The wrap measures approximately 13” x 3.5” and is made of neoprene rubber laminated on both the inner and outer surfaces with knit fabric. There is a 1-1/2" x 3" piece of hook-and-loop fastener strip in the center and a corresponding piece of hook-and-loop fastener strip on one end. At the other end is a small hole for the thumb to fit through. The wrist wrap contains 10 disc-shaped, non-removable magnets. The magnets are sewn to the underside of the wrist wrap over the palm area. The item is advertised as follows: “Quiet throbbing wrist and thumb pain. Help calm throbbing tendonitis or carpal tunnel symptoms with this flexible elastic wrap. Provides optimal compression with full range of motion. Fits right or left wrist. One size fits most. Washable. Ten powerful magnets.” You suggest that the wrist wrap is classifiable under subheading 9021.10.0090, Harmonized Tariff Schedule of the United States (HTSUS). Heading 9021, HTSUS, covers orthopedic appliances which are defined as appliances for preventing or correcting bodily deformities; or supporting or holding parts of the body following an illness, operation or injury. The ruling request states that the instant article is a “flexible elastic wrap” that “provides optimal compression with full range of motion.” The instant article does not immobilize the hand or keep it from bending, which would allow healing of the inflamed tendons and/or nerves. This article does not provide the same level of support as orthopedic devices of heading 9021 since it fails to provide post-surgical support to an organ, or prevents anatomical deformities.
