GRI rules applied: GRI 3(b)

Product description

The submitted sample, identified as the children’s Chained Ghost Costume, consists of a robe, hood, gloves and a headband. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the flimsy robe imparts the essential character of the set. The flimsy robe features raw, jagged cut edges on the sleeves and hem, and loose, visible overlock stitching with hanging threads at the neck and the hook and loop tab closure. The costume will be imported in sizes medium, large and extra large as item numbers, 5144373, 5144374, and 5144375, respectively. The sample will be returned to you as requested.
