Box 14939 Augusta GA 30919 RE: The tariff classification of a sports compression arm sleeve from Mexico Dear Mr. Rizner: In your letter dated January 30, 2015 you requested a tariff classification ruling. Your letter was accompanied by a sample. The sample, Style 224099 “Dagger Sleeve,” is an arm sleeve which you state is intended to be worn in the sport of basketball primarily to keep the arm muscles warm and wick sweat away from the body. The arm sleeve is constructed from an 84 percent polyester, 16 percent spandex knit compression fabric. The item is tubular in shape with an elasticized opening at the upper end and covers the upper arm to the wrist. The upper opening is slightly larger than the opening at the bottom to ensure a snug fit. The item is imported in two sizes, S/M and L/XL. The applicable subheading for the “Dagger Sleeve,” Style 224099, will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up articles, including dress patterns: Other: Other: Other: Other: Other.” The rate of duty will be 7 percent. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on the World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The sample will be returned to you as requested.
