The submitted sample, identified as CS034 FR Cap, is a mattress cover. The cover is made from a jersey knit fabric that you state is composed of 40 percent glass yarn and 60 percent rayon. It is stylized similar to a fitted sheet and is fully elasticized. This cover is not the type of mattress cover that is normally classified as bed linen. The rayon provides the essential character of the cover. The applicable subheading for the mattress cover will be 6304.91.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: knitted or crocheted... of man-made fibers. The duty rate will be 5.8 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
