Austrins Clark Hill PLC 150 North Michigan Avenue Suite 2700 Chicago, IL 60601 RE: The tariff classification of hunting gloves from China Dear Ms. Austrins: In your letter dated March 24, 2014, you requested a tariff classification ruling on behalf of your client, NTA Enterprise, Inc. Style 1039-21OT, “Sensor Shooter’s Glove”, is a full fingered hunting glove with a palm side constructed of, what you state is 100% polyester knit fabric coated in silicone, with the exception of the trigger finger, which is you state is constructed of spandex, and the thumb and trigger finger tips which you state are constructed of a conductive material to be used with touch screen electronic devices. The spandex material allows for a tighter and more sensitive trigger finger. The silicone coating provides a better grip for the hunter to hold the rifle. This layer is bonded to a polyester fleece liner material, which you state has been chemically treated for scent reducing purposes. The backside of the glove is constructed of what you state is 96% polyester, 4% spandex knit fabric, with a polyester waffle design on the inside, providing additional warmth to the wearer. The glove features fourchettes, a camouflage pattern, and a hook and clasp. The essential character of the glove is imparted by the coated knit palm side material. The culmination of features, in conjunction with the marketing and advertising materials, indicate that the glove has been designed for use in the sport of hunting. The applicable subheading for this style will be 6116.10.0800, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8% ad valorem. Duty rates are provided for your convenience and are subject to change.
