Dear Ms. Groff: In your letter dated November 22, 2013, you requested a tariff classification ruling. The submitted sample, identified as Cobra, item number 90197, is a black 100% polyester long cape, which you refer to as a robe, which has an attached latex headpiece. The single layer cape has visible loose overlock stitching running down the entire length of the front opening and the entire length of the hem. Although you state in your ruling request that you are enclosing five costume samples, only the Cobra sample described above was included with your ruling request. The applicable subheading for item number 90197 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
