The submitted sample is a yard bag woven of polypropylene strips that measure 2-3 mm in width. The strips meet the dimensional requirements of textile strips contained in Section XI, Legal Note 1(g), Harmonized Tariff Schedule of the United States (HTSUS). According to the terms of Legal Note 1 to Chapter 54, HTSUS, such strips are not to be considered a man-made fiber. The bag measures 96 cm x 96 mm x 100 cm. While you state that the woven fabric is coated, it is a coating that is not visible to the naked eye other than by a change of color; this construction is considered a textile fabric for tariff purposes. It has a cover and two handles, also woven of textile strips. You state that following: “The yard bags will be sold for consumers to use in various projects including outdoor storage, yard clean up, etc.” It is not for transporting merchandise. The applicable subheading for the domestic yard bag will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The sample will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
