Each of the two submitted samples is identified as a Scarf Hanger, item number 930986. This item is imported in two different styles; one shaped like a flower and one shaped like a butterfly. The flower-shaped section and the butterfly-shaped section of the respective styles is each made of molded acrylonitrile-butadiene-styrene (ABS) plastic material. Each of the two styles has a top hook made of metal. The plastic section of the flower-shaped hanger is coated or covered with a pink textile flocking material, giving it a velvet-like appearance. It is designed with 12 petal shaped cutout apertures through which scarves, wraps and mufflers can be hung. The plastic section of the butterfly-shaped hanger is not coated or covered with flocking material and is pink in color. It is designed with 14 cutout apertures through which scarves, shawls and mufflers can be hung. Each of the two styles is also imported in a green color. As you requested, the sample will be returned to you. This item is considered to be a composite good within the meaning of General Rule of Interpretation (GRI) 3. The molded plastic material provides the hanger with the body that enables it to perform the primary role of supporting clothes that will be hung from it. The flocking material of the flower shaped hanger performs the subordinate role of protecting the garments that will be hung from the hanger while keeping those garments in place. The metal top hook of each of the two styles performs the subordinate role of facilitating the hanging of the hanger from a closet bar. Therefore, it is the opinion of this office that the molded plastic material provides each of the two styles with the essential character within the meaning of GRI 3(b).
