N244044 July 22, 2013 CLA-2-90:OT:RR:NC:4:405 CATEGORY: Classification TARIFF NO.: 9032.10.0060 Ms. Sheila Hawkins Dometic Group 509 S Poplar Street LaGrange, IN 46761 RE: The tariff classification of a thermostat from Canada Dear Ms. Hawkins: In your letter dated July 9, 2013, you requested a tariff classification ruling. A sample was provided. Per your letter, you state, regarding the sample, #722200200: “This thermostat is manufactured by Etratech in Canada and is used with our marine air conditioners. The thermostat may be mounted in the cabin, or at the helm. It contains buttons to set the desired temperature, and then the thermostat automatically controls the air conditioning unit to maintain that temperature to that setting.” We agree that the applicable subheading for the thermostat, sample #722200200, will be 9032.10.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other” thermostats for air conditioning, refrigeration or heating systems. The rate of duty will be 1.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
