Dear Ms. Gauger: In your letter dated April 29, 2013, you requested a tariff classification ruling. The item in question is described as a natural, liquid dairy creamer used in coffee. The stated ingredients are skim milk (40-50%), heavy [36%-fat] cream (22-25%), sugar (32-35%), and stabilizers [sodium citrate, carrageenan and salt] (1-2%). The product will be packed in 32-ounce aseptic PET bottles. The applicable subheading for the liquid dairy creamer, if entered under quota, will be 0402.99.7000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for milk and cream, concentrated or containing added sugar or other sweetening matter: other: other: other: described in additional U.S. Note 10 to chapter 4 and entered pursuant to its provisions. The general rate of duty will be 17.5% ad valorem.
