Berger, d/b/a/ Mardi Gras Imports of Slidell, Louisiana. You submitted a sample of a functional child-sized umbrella, style #TR-207. You say in your letter that this item will be used as a party give-away. The umbrellas are thrown to revelers from Mardi Gras floats during parades. However, this article is not a decoration but rather a utilitarian article excluded from classification as a Festive or carnival article by Note 1(v) to Chapter 95, Harmonized Tariff Schedule of the United States, (HTSUS). The rate of duty will be 8.2% ad valorem Duty rates are provided for your convenience and are subject to change.
