Dear Ms. Kessens: In your letter dated March 4, 2013, you requested a tariff classification ruling. The sample will be retained for our files. You have submitted a sample of a hair scarf, identified as SKU number 02380668, which is constructed of 100% nylon fabric. Although you state that the item is woven, upon examination it was determined that the fabric is actually of knit construction. The hair scarf is rectangular in shape and measures approximately 58 inches in length by 14 ½ inches in width when unfolded. The hair scarf wraps into a variety of fashionable styles while protecting the hair. The applicable subheading for SKU number 02380668 will be 6505.00.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hats and other headgear, knitted or crocheted,…hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid, Other: Other: Other.” The rate of duty will be 20 cents per kilogram plus 7 percent as valorem. Duty rates are provided for your convenience and are subject to change.
