Dear Ms. Liu: In your letter dated February 20, 2013, you requested a tariff classification ruling. The merchandise under consideration is referred to as the 12 pcs Stoneware Dinnerware Set, item number A075AA04860. From the information you provided, it consists of four dinner plates which measure 10.5 inches in diameter and cost $0.695 each, four salad bowls which measure 7 inches in diameter and cost $0.41 each, and four handled 14-ounce coffee cups which cost $0.3975 each. You state that all of these items are made of stoneware ceramic and are sold for use in the home. The applicable subheading for the 12 pcs Stoneware Dinnerware Set, item number A075AA04860, will be 6912.00.4810, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Ceramic tableware…other than of porcelain or china: Tableware and kitchenware: Other: Other: Other: Other: Suitable for food or drink contact.” The general rate of duty will be 9.8 percent ad valorem.
