Dear Ms. Concepcion: In your letter dated October 17, 2012, you requested a tariff classification ruling on behalf of your client, E.H.L. Imports Ltd. The sample submitted will be returned. Style 922 is a women’s camisole constructed of 95% nylon and 5% spandex knit fabric. The garment features a hemmed bottom, flatlock stitching at the arm and neck openings and a scooped neckline. The applicable subheading for style 922 will be 6109.90.1065, Harmonized Tariff Schedule of the United States (HTSUS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of other textile materials: of man-made fibers: women’s or girls: tank tops and singlets: women’s. The rate of duty will be 32% ad valorem. You assert that the proper classification should be 6212.90, HTSUS, which provides for other body supporting garments; however, this garment does not provide sufficient support to be considered a body supporting garment.
