The subject product, Linaclotide, imported in 145 mcg and 290 mcg capsules, is a guanylate cyclase-c agonist. Currently, it is undergoing phase III clinical trials for the treatment of irritable bowel syndrome with constipation (IBS-C). The applicable subheading for the Linaclotide imported in dosage form will be 3004.90.9160, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the digestive system: Other."
